Terms and conditions

I. Scope of Services 

These Terms and Conditions constitute a legally binding agreement made between LIVE FOLKS, a travel agency and tour operator in Panama (“Live Folks,” “we,” “us,” “our” or “Company”), and you, the customer (“you”, “your”, “Participants”, or “Customer”), by accessing, browsing, or using our website (https://www.livefolks.com) or any LIVE FOLKS-affiliated website, travel agents, OTAs and concerning your use of our services, including but not limited to booking tours, transportation, accommodations, Incentive travel and related travel arrangements. By booking with Live Folks, you acknowledge that you have read, understood, and agree to be bound by all of these Terms and Conditions.

II.Services

We provide tours and related services including guided excursions (“Tours”) as a Tours Operator and as well as holiday packages and other Travel Arrangement as a Travel Agency / DMC. These Terms apply to all services provided, whether booked directly through our website, through a third-party agent, or via other platforms.

III. Eligibility

To book travel services or a tour with LIVE FOLKS, you must:

  • Be at least 18 years old or have the consent of a parent/guardian to book and participate in the tour.
  • Agree to provide accurate information about yourself and any other participants in the booking.
  • Minors (under 18) must be accompanied by an adult during the tour.

 IV. Booking and Confirmation

All bookings can be made through our website, through email, by phone or WhatsApp chat / call. A reservation is only confirmed upon receipt of the partial or full payment, depending on the service booked.

  • For all bookings made on our website travelers will receive an instant booking confirmation via email along with their booking receipt and electronic voucher /ticket.
  • For bookings made via email, over the phone or on WhatsApp chats, booking will be manually confirmed once the payment has been successful.

 V. Pricing and Payment

Price: All prices are listed in U.S. dollars (USD) unless otherwise stated and are subject to change without notice. Prices include only those items specifically listed in the tour or service description.

  • Day Tours: The full tour price is due at the moment of the booking on our website or through customer care.
  • For all other quoted travel services payment is based on terms indicated in the services.

Payment: All payments are processed through a third-party specializing in secure online transactions, we use the following gateways to process all payments, Authorize.net and PayPal.

  • We accept Visa and Mastercard through Authorize.net payment gateway
  • We accept all other credit cards through PayPal.
  • We also also Bank Transfers for Tailor-made Travel Arrangements.

VI. Cancellations and Refunds

Cancellation by You (Customer):

We offer free cancellation at any time for any reason through the Self-managed booking feature available on travelers electronic tickets /Voucher or through our customer care email bookings@livefolks.com .

  • Cancel 48 hours before the booked date to receive a Full refund no question asked.
  • No shows (if you do not show up for the tour) are not eligible for a refund.

Cancellation by LIVE FOLKS:

We reserve the right to cancel a tour at any time due to unforeseen circumstances such as force majeure, weather conditions, or insufficient participation.

  • We will notify you that you are unable to operate the tour and offer you an alternative with the same monetary value and similar activities.
  • We will reschedule the tour to a later date, at a maximum of 3 days, and inform you beforehand and to make sure you will be available.
  • In the rare event that we are unable to operate the tour due to unforeseen circumstances or force Majeure, and it is not possible to reschedule for a convenient date, we will issue you a hundred (100) percent refund, guaranteed.

VII. Amendments to Bookings:

  • You can make changes to your booking free of charge through the manage booking feature up to 72 hours before the booked date (add or remove participants without the need to contact the customer care department)
  • You can also request any changes to your booking through our customer care department free of charge up to 72 hours before the booked date.
  • All changes made required 48 hours or less before the booked date will depend on availability and will incur additional charges of $30.00+ USD per person.
  • We reserve the right to modify itineraries due to unforeseen circumstances or events beyond our control. We will make every effort to provide you with comparable experience.

VIII. Terms of Participation

By participating in a LIVE FOLKS tour, you agree to the following terms:

  • Travel Documents: It is your responsibility to ensure that you have a valid passport, visa, and any other necessary documentation for your travel.
  • Health and Safety: You are responsible for ensuring you meet any health requirements for travel and any specific requirements of a tour.
  • Personal Belongings: We are not liable for loss or damage to personal belongings during your trip.
  • Insurance: It is strongly recommended that all participants have personal travel insurance, including coverage for accidents, medical expenses, and lost or stolen items.
  • Behavior: You are required to follow all instructions provided by LIVE FOLKS staff and tour guides and comply with the laws and regulations of the local area. Any participant who acts in a disruptive or dangerous manner may be excluded from the tour without a refund.

LIVE FOLKS reserves the right to exclude any participant from the tour if they do not adhere to these Terms, including any behavior that compromises the safety or enjoyment of other participants.

 IX. Liability and Disclaimers

LIVE FOLKS and its partners act as Travel and tour organizers, and while we take reasonable care to ensure your safety, you participate at your own risk.

  • Limitation of Liability: LIVE FOLKS will not be liable for any personal injury, loss, theft, damage to property, or delay caused by circumstances beyond our control, including but not limited to acts of God, war, terrorism, force majeure events (e.g., weather, natural disasters, strikes).
  • Third-party Providers: LIVE FOLKS is not responsible for the acts or omissions of third-party service providers for activities not operated directly by us such as but not limited to domestic flight, third-party transportation, Accommodation with or without breakfast included, lunch, dinner reservations, boat ride, zip line, snorkeling, rappel, horse riding. Any complaints or claims regarding their services should be directed to them.
  • Property Loss: LIVE FOLKS is not responsible for the loss, theft, or damage of any personal items, including valuables or equipment, during the tour.
  • Exclusions: To the maximum extent permitted by law, Live Folks shall not be liable for any indirect, incidental, special, or consequential damage arising out of or in any way connected with your use of our services, including but not limited to loss of profits, loss of data, or personal injury.

 X.Data Protection and Privacy

By booking tour or travel services with LIVE FOLKS, you consent to the collection and processing of your personal data as required to process your booking and provide our services. Your data will not be shared with third parties except as necessary to fulfill the tour or as required by law.

For your protection, we use secure, encrypted payment gateways for all transactions, and we do not store any financial details.

  • Data Collection: We collect personal information from you for the purpose of processing your booking and providing you with our services.
  • Data Use: Your information will be used to communicate with you, make reservations, and provide customer support. We may also use your information to send you promotional materials, but you can opt out of receiving these communications at any time.

XI. Amendments
We reserve the right to amend these terms and conditions at any time. Any changes will be posted on our website. Your continued use of our services constitutes acceptance of the updated terms.

XII. Intellectual Property

  • Ownership: All content included on our website, including text, graphics, logos, and images, is the property of Live Folks or its licensors and is protected by copyright and other intellectual property laws.
  • Restrictions: You may not reproduce, distribute, or modify any content from our website without our prior written consent.

 XIII. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Panama. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts in Panama.

 XIV. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of law, the remainder of these Terms shall remain in full effect. The invalid provision will be replaced with a provision that most closely reflects the original intent.
